Hi,
I graduated on May 2008 with an MBA degree. My OPT started in Jul 2008 and is valid till Jul 2009. I am not eligible for 29month extension.
I was on an internship till Jan 30th 2009 and am looking for fulltime positions now.
I understand that I will have to file for H1 on April1st and I can stay in the US and work legally if my H1B is still in process under the cap-gap rule passed last year.
How long can I legally stay in the US on OPT without a job?
Can anyone please throw light?

Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
2. what are the consequences of using AP within 180 days after filing for 485 ?
3. Is AP and AC21 related ? [brother, sister , cousin :) ]

The United States Citizenship and Immigration Service (USCIS) has recently issued a fact sheet (http://www.aila.org/content/fileviewer.aspx?docid=30372&linkid=210853) reminding qualifying applilcants to apply EARLY for an Advance Parole document, as Advance Parole processing times take about 90 days.
The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization
If you are an Appllicant with a pending Application for Adjustment of Status to Lawful Permanent Resident (LPR) and need assistance with filing Form I-131 (http://www.uscis.gov/USCIS/New%20Structure/2nd%20Level%20(Left%20Nav%20Parents)/Forms%20-%202nd%20Level/Forms%20Static%20Files/I-131.pdf), contact our office, as we currently have a SPECIAL running for the preparation and filing of the Advance Parole (http://www.h1bvisalawyerblog.com/2009/10/special_ead_and_advance_parole.html) document.

If the job description on the Labor allows 3 year degree. And if it is properly filed by the lawyer than there should not be any problem. I know few people who got their I-140 (EB3) approved from NSC with 3 year degree.

We just received the ASC notice for biometric notice. The date they provided is the same date where we have an appointment in Mexico US Consulate.
Any experience for re-scheduling the biometric appointment. We would like the appointment to be earlier.

Dear Experts/Lawyers,
I wanted to ask a question about my status based on the situation described below:
1. I entered the United States on F1 Visa in 2003.
2. Applied for and got H1B approved, with the bottom right part attached. The visa was valid till November 2008.
3. Applied for and got H1B extension approved, with the bottom right part attached. The visa is valid till November 2011.
4. Never left the United States since I entered in 2003 on F1 Visa.
5. My passport expires in the middle of 2010.
Based on this, in order to ensure my legal stay in the United States, do I need to do anything, except renew my passport at some point of time before it expires, in terms of either having to leave the US, or go to some agency to update something? Please suggest. Thank you for your help.

I think you have to wait until your 3yr H1B is clear. If you find a new job before your current H1B expire, you may not have enough time left on your H1 to get the new GC labor and I-140 approved.

My I-140 will be approved shortly in premium processing and I'll be applying for 3yr H1 extension. There is a chance that I may get laid-off soon and I wanted to know if I can change the jobs while my H1 extension petition is pending with USICS. My current H1 will expire in June'07.

After many, many years of wait ( to be exact totally 8 ) I was about to pack my belongings and move on with my life but in other place.
For certain reasons, which I will not discuss there I could not return to my home country.
Looking back and analyzing decisions made by the HR and the lawyers that the company hired to handle my case I feel something very uncomfortable. My advice to those who are at the very beginning of the immigration path is "Never under any circumstances trust the immigration lawyer that was hired or recommended by your employer. Remember your employer's interests are exactly opposite to yours."
Anyway yesterday I got that coveted �We sent you an approval notice..." e-mail.
Am I excited? Not very. Certainly I would have been if this happened many years ago.
Another advice that I want to give is do not take this green card business to close to your heart. There are much more important things in this life.

With the D100 now carrying a street price of $1499 from legitimate dealers...things are looking mighty nice as the price of admission for quality gear keeps going down.
There are regular refurb D100 for $1,199 on the market recently.
If you want the best value for money, the E+ rated, at Adorama now, 35-70/2.8 AF-D and 80-200/2.8 AF-D are the best buy in town. I always tempted to get them to add a few zooms to my primes.
But until the 1Dx comes out which is 4mp, and the 1Ds holds a price above $6,000 until April, I am NOT buying any more Nikkors, unless the FF digital F6 announces on time, which I think is an impossibility!

I have appied EAD and AP together for me and my wife.
I didn't receive the receipt notice for my wife EAD but the check is in cashed. when my wife called TEXAS center, IO told it was rejected by mistake and reprocessed.
She will call again tomorrow to find more. Her online status is still, petition is not signed and rejected. Application mailed back. But I didn't get the any document in mail.

My husband is in H1B visa and he transfered his visa to another company. Got the I-797 approvals too. Along with that mine and my kids H4 also got approved.
Now I am urgently required to travel to India, and want to return from India without going for stamping. Here are other details.
1) Even my previous H4 visa is not expired while I return from India.
2) I have the new H4 approval notices and copy of husbands new H1s I797 with me.
Will it be an issue if I reenter without stamping. Our plan is to go for Visa stamping to any nearby consulate in US border after I come back. Please advise.
