How do i find out if a RFE has been issued on a case?
Does USCIS "check case status" mentions it? My lawyer is one heck of a person and i have to keep track of my case.
I saw the case status online and it says "Request for Additional Evidence Sent".

Its not a problem. As long as your I-485 is applied and pending , you can apply any time.

have u seen the legal immigration/ foriegn workers issue address by Bush today. althou he spoke just 1-2 sentences. stating that ' legal immigration system needs to be fixed, so that foriegn workers are in no harm
Bush did not mention a single word about legal immigration. He was referring to foreign (limit/read that as Mexican) workers and putting in place programs to stem the flow of additional undocumented ones. He spoke just over a minute and there was not a bit to be gleeful about for legal immigrants.

These tough times for folks like me have been there for the past several years. Now, I am hoping the letters campaign does make an impact and get the much required good will.
As a side note, seems like the writers have sort of given up already on his last year of his presidency as the entire speech was rather mundane. In a troubled time for the entire country with the economy down, house market bust, recession looming, he chose to highlight the past and glorify to garner legacy.
Will it be a year of inaction? I hope not, lets us do our bit by supporting efforts of IV.

The answer should be "yes". The job should be offered to foreign national for processing his/her PERM or GC. However, the job can be accepted by FN, only after USCIS authorization. That authorization can be either H1 or EAD or GC itself. In other words, you can accept the job even after getting GC; however, in order to process your GC, there should be always a job offer for you from sponser right from begining(PERM LC).

I would anticipate EAD to be processed in max of 3 months and AP in 2 months.
Would also add a buffer of 2 weeks (just in case).

From what I know, it is not mandatory to file AC-21 but if you think your previous employer who filed for your I-140 can create problems for you, it's safe to file AC-21. Although, your previous employer can not withdraw your I-140 by law, some employees attempt to withdraw/cancel I-140. Sometimes, USCIS behaves in an un-expected manner and they might issues a NOID on your 485. If that happens, you will have to appoint an attorney who fights for you to repeal USCIS decision. You will win in the end, but you will go through some unwanted stress and will loose some money to the attorneys. In such cases, if you have filed for AC-21, it acts as another strong point to your fight against a erroneous decision from UCSIS.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
2. Can she use Premium Processing for H1 transfer?
#1 - Yes, as long as the PERM is pending and at least 365 days old at the time of filing H1B extension
#2 - Yes, Premium processing available at the additional cost of $1000

You must have I94 showing H1B classification and validity dates to change status to H1. You can travel and re-enter with a H1 visa stamp and obtain h1 status. Please check with the company attorney,

I would suggest just show the salary and what you have in the bank in USA. That would be good enough. If you see the question....it asks for how much money you have in the US banks and not in outside banks. So you do not need to put that in this form.

Same is the case with AP..! No news at all for EAD & AP..Worried now!
Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!

I am posting this question on behalf of a friend who needs some guidance w.r.t. H4 extension.
His H1b expires at the end of this month and he had applied for an H1b extension during Nov '06 after he received his I-140 approval. He received a RFE this week with USCIS requesting for additional documents. He had not applied for H4 extension during Nov '06 as his wife just moved to US in Jan 07. Her H4 expires at the end of this month. His problem is if he can apply for H4 extension for his wife, even though his own H1b has still not been extended due to a RFE. He can continue working as his application is still pending with USCIS but can he apply for H4 extension for his wife along with the additional documentation he is now going to send to USCIS in response to the RFE? Or can he apply for H4 extension based on the H1b receipt notice from USCIS? Or does he have to wait until he receives his H1b extension approved before he can apply for H4 extension? Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?
Thank you for any and all help you can provide.

JakeJake, am not sure but have heard from some previous GC holders that once you surrender then it is very difficult to get it back. She might have to start all over again. Have u checked with any attorney regarding this?

Use latest I-94 from H-1 as the old I-94 is supposed to be old after the new one arrives with the H-1 approval ...
