If she is out of the USA, what you could do is file a 'follow to join' petition with the US consulate in your country when your PD is current. You could file this if the marriage occurs before your GC is approved.

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

Guys,
I am July 3rd RD, 485 EBe Filer. My wife received her EAD. We had our FPs done and all cheques cleared.
My status shows that my application has been transferred from Nebraska to Texas on Sept 6th.
However, I am yet to receive my EAD.
I made an Infopass appointment for interim EAD. Is there anyone in the same boat?

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.

Good morning! Please clarify for my case details given below :
Labor approved, I140 denied for ability to pay. Employer had filed MTR with current tax returns documents. The labor has been filed & approved less than 180 days and I140 pending with MTR. H1B expires in 15th May 2011 completing all six years and no recapture periods left.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all)
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?
EB2, if your I-140 approval reads as "Section: Mem of Profession w/Adv Deg, or of Exceptn'l Ability Sec.203(b) (2)" You should be worried only if you had two different 140 with the same employer. Take infopass and give a try, there is no standard procedure to find out.

Don't do it. Your F-1 Visa will most probably be rejected due to this out-of-status issue. You might be able to get a new I-20 from outside the country but not a VISA.

Stick with Purdue and do as the International Advisor says (you don't have many options). Hopefully you will be reinstated (Purdue should have issued a new I-20 when they re-admitted you from community college. I am not sure why they overlooked)>
